Frequently asked questions

I have a freelance contract — can I still be classified as an employee?
Yes. What matters is not the contract's title but whether you work under instruction, externally directed and in personal dependence; if so, it is an employment relationship (false self-employment) — BGB § 611a Abs. 1, as of 2017.
Is a termination by email enough?
No. A notice of termination or a termination agreement requires the hand-signed written form; electronic form (email, PDF) is expressly excluded, and a termination declared that way is void — BGB § 623, as of 2000.
What notice period normally applies?
The statutory basic period is four weeks, to the 15th or to the end of a calendar month — BGB § 622 Abs. 1, as of 1993.
What notice applies during probation?
During an agreed probation period of at most six months, the employment can be terminated on two weeks' notice — BGB § 622 Abs. 3, as of 1993.
Does the notice period get longer over the years?
For terminations by the employer the period increases in steps with length of service — up to seven months to the end of a month after 20 years — BGB § 622 Abs. 2 Nr. 7, as of 1993.
As a freelancer, am I a liberal professional or a trader?
Scientific, artistic, writing and teaching activities and the listed catalogue professions count as liberal-professional and are not subject to trade registration or trade tax — EStG § 18 Abs. 1 Nr. 1, as of 2002.
