How much is the deposit for a Spanish rental?
For a dwelling it is one month's rent; for use other than permanent housing (seasonal, commercial) it is two months' rent (LAU art. 36.1) (a fecha de 2026).
Is the deposit updated during the lease?
During the mandatory extension period the deposit is not updated (LAU art. 36.2) (a fecha de 2026). Later adjustments may follow the agreed terms.
When and how is the deposit returned?
At the end of the lease the landlord returns the fianza, less any amounts the tenant lawfully owes (e.g. unpaid rent or damage beyond normal wear). A specific refund deadline or default interest is not covered by the facts used here and depends on the applicable rules. General information.
